Terms of Service & Senior Instructor Liability Disclaimer

Operational boundaries, dynamic safety governance, and liability division for training centers and staff.

These Terms of Service govern the use of the Irish Sailing Notes platform by sailing schools, recognized training centers, Senior Instructors, instructors, and staff.

Limitation of Liability & Dynamic Safety Responsibility

  1. Operational Discretion: Irish Sailing Notes provides live wind, gust, tidal, and weather advisory indicators strictly for administrative organization and convenience.
  2. The Senior Instructor as Sole Authority: The platform does not under any circumstances provide automated, definitive safety clearance. The on-duty Senior Instructor (SI) retains absolute, non-transferable authority and legal responsibility for all dynamic risk assessments, 'Go/No-Go' fleet launching decisions, and safety management.
  3. Exclusion of Liability: The platform operator carries no liability for physical injury, asset damage, fleet losses, or operational safety failures occurring at an affiliated training center, regardless of the indicators displayed on the dashboard. By using this system, the School and its administrators agree to insulate the developer from all insurance, third-party, or regulatory liabilities.

1 Nature of the Service

Irish Sailing Notes operates as a cloud-based management platform assisting Irish sailing clubs and recognized training centers with course administration, instructor rota coordination, boat fleet allocation, and syllabus progression tracking.

2 Dynamic Safety & Launching Authority

All weather data, tidal forecasts, wind sensor streams, and "Go/Caution/No-Go" status badges rendered within this application are decision-support aids only. They do not constitute nautical or meteorological advice. In accordance with Irish Sailing and national marine safety practices, on-the-water safety determinations remain exclusively with the designated Senior Instructor on site.

3 User Accounts and Training Center Compliance

Schools and training centers are responsible for vetting instructor credentials and ensuring compliance with Irish Child Safeguarding standards and the Children First Act 2015. Instructor qualification vault entries are shared strictly on an explicit opt-in basis by the instructor.
